Oh pls yes!

But....If I may be part of the gallery....sharpen my pencils and take notes of what would be, in my forecast, a wonderful debate between to very passionate and different masters of words and expression!

That Oscar's lawyers could use such pettifogging serpentine casuistry to defend a murderous rascally knave is repugnant even to Human Nature.

And there has sprung up a young generation of malcontents who have taken to support him on Twitter and Facebook, in a daringly perverse and irrational way.

And it hath also been displayed in this thread by these deluded souls in such an odious way -
notwithstanding all decent remonstrances and all the laws of common decency.

@deamonza do I really have to repeat myself? Everything I stated was evidence in a court of law. Reeva was shot not once, not twice but 4 times by Oscar. As a matter of fact I do know a bit about guns. My ex husband carried one. It is not a mockery to stand for what is right but a hope that in the future other victims (Dead or alive) will get justice. How do we ever expect to lower crime rates on anything if nobody ever gets justice? A crime is a crime. Publicity or no publicity. There are some things that will not change but there are some things that we can still stand up for. I stand by what is right. What if it was your daughter or son? Would you still be defending him? He should of been more careful. You can't tell me he couldn't have fired a warning shot.

Am I the one behaving irrationally... I am asking for rule of law to be observed and allowed to rule without political and media interference.
I am not the one making emotional arguments, which have no place as evidence in a court.

Sometimes we just want to bring things into debates that don't even apply. How on earth politics comes into this trial is beyond me. Let me guess, is it the presence of the useless ANCWL in court? Judge Masipa handled herself, the case and the media quite well and was not influenced one bit by the shenanigans playing outside the courtroom. Yes, she erred in her interpretation of dolus eventualis but hey guess what, the SCA exists for that reason ie to hear appealed cases were the accussed feel that the judge might have erred. Many low and high profile cases have gone before the SCA. Were all those judges who erred, politically influenced? Were they all sexually influenced perhaps? Maybe emotionally influenced? Maybe they faked their LLBs or whatever qualification is required? NO is the answer...they just misinterpreted the law...Simple as ABC!

As for Oscar, sadly as he has been a good prisoner, his sentence has a high probability of being reduced which will further raise the blood pressure of social media lynch mob who'll undoubtedly curse Judge Masipa again. Let's just hope his conscience deals with him.

Savanna : @deamonza do I really have to repeat myself? Everything I stated was evidence in a court of law.

DeamonZA : No, what you have said about him is in fact verbal testimony, not evidential fact. There is no evidential fact regarding his behavior with firearms.
There is only stories and anecdotes. I can say you chop the tails off puppies in a court of law, does that mean its true in the absence of proof that you didn't ?

Savanna : Reeva was shot not once, not twice but 4 times by Oscar. As a matter of fact I do know a bit about guns. My ex husband carried one.

DeamonZA : He probably also drove a car, that does not make you a F1 Driver does it ? The fact that your ex had a firearm means nothing, at all.
I am using actual laws and actual rules regarding the gun laws in SA.
Anyone who has ever attended any tactical/SADPA/IPSC/Military or police training will tell you there is almost never a case in a described defensive situation where there is only a single shot fired... Jesus, just youtube shootings in SA and you will see it for yourself.

Savanna : It is not a mockery to stand for what is right but a hope that in the future other victims (Dead or alive) will get justice. How do we ever expect to lower crime rates on anything if nobody ever gets justice?

DeamonZA : The relevant word here is Justice, there is no justice in this. It is not been driven by a quest for justice but by many other outside factors and Justice can never be served when you are answering to many masters. Justice is total equality under the aegis of the law, not selective prosecution based on your fame level and public outcry.

Savanna : A crime is a crime. Publicity or no publicity. There are some things that will not change but there are some things that we can still stand up for. I stand by what is right.

DeamonZA ; Really, as you break the laws of this country on a daily basis, by all means, hand yourself in if you want to take the moral high ground.

Savanna : What if it was your daughter or son? Would you still be defending him? He should of been more careful. You can't tell me he couldn't have fired a warning shot.

DeamonZA : Please can you reference in the Firearms Act the requirement for warning shots ? Here's a fun fact, you are more likely to be arrested for negligence if you fire a warning shot and the criminals back off and run away... why ? you ask, well if you have space to fire to warning shot you have space to retreat, if you time to fire a warning shot you have time to run away... this is based on actual rulings from the Registrar...
And yes, he should have been more careful, that is why he was found guilty of Negligent Homicide, please pay attention as you are making circles again.

Please also note, you are making this an emotional argument again, by all means argue the merits of the case and I'll listen and evaluate it.
The law is not supposed to be influenced by mass hysteria and the baying for blood by the general public. Please google what the statue of Justice symbolizes and maybe try to understand why we have to keep our courts out of the realms of political and media influence as much as possible.

key words....MERITS OF THE CASE...precedence old..... or..... new to be set.

the judge should not be swayed by human emotion.

otherwise the judiciary would be a shambles.

callous? .......YES

There is no point arguing with a brick wall. Check your gun license laws again. He still shot someone without knowing if they were a threat.
