Nope. 1) No contract (including agreed to terms and conditions) can supersede the law, so "the fine print" is irrelevant. 2) ESA's core business is advertising, if anything they would/ should be expected to have higher standards of diligence than a publication that offers it as an incidental service.

ESA's business is advertising, there are plenty of laws and regulations that are applicable. They can't have it both ways -when they are accused of pimping say oh no we're an advertising platform, whatever happens is between consenting adults..."(see the generic disclaimer on every profile) *AND* then when held to usual advertising standards say "we operate in the grey area / fringes" so the law doesn't apply. Either they are a legitimate (advertising) business (subject to the usual laws) or they aren't - they can't be one when it suits them, and not be one when that suits them better.

Perhaps some logic in what you're saying, but things don't work this way. I can't hold the owner of a vehicle ad platform to account when a dealer or private owner knowingly sells me a lemon. It's exactly the same principle here.

I do think it would be highly amusing if someone would bring this before what ever the relevant advertising standards authority is. "I feel done in because the escort I was with last Wednesday seemed 15 years older than her ad states"...

well, it would depend on what the car ad said - if it made deliberately misleading factual claims, then actually you maybe could (although most cars are sold "voetstoets" or "as is" which implies that you're entitled to inspect the vehicle, but any discrepancy between the ad and the inspection (e.g. miles on the speedo) is superseded by the inspection, so you can't claim "you were misled"). If it made generic claims like "this is a great car", then the courts draw a distinction between "factual claims" and "puffery" (legally allowed exaggeration) (the example above of "promise to make your dreams come true" or whatever it was, is undoubtedly puffery.

I agree no one would pursue it, but the question of whether a punter is willing to have a court enforce his rights as a consumer is separate from whether the law exists and/or is applicable.

Lets go back a few pages to the very first post of what this post was all about. It was about a punters who blames venues when they not happy with a specific girl in the room. Cause some of you are so intitled u want everything perfect cause your life is perfect and the world is perfect.

Teletubby. U kak and kerm cause there is another teletuby on esa as a punter. Trademark your name if its a problem

Voetstoots you say. No car is allowed to be sold voetstoots anymore. Do u even know the meaning of the word. Go google it. Also dont try or think you know everything of anythimg cause sometimes it comes down to you know nothing of fuckall.

So when u are done swinging your dick around. Lets get back to the actual post.
And its about a girl in a venue that wasnt good enough for the client. And its the venues fault

For quit a while now punters on the forum has been going at esa when they not happy with a girl, or just not happy with the front page of esa. Fuck me. A girls said earlier. Do your homework before the booking. A while ago a punter complained about being asked too many questions when making a booking. Its to make sure you gets the right girl. Most of u cry about something or everything. Most of you forget about the verbal abuse some of the girls experienced when the guy wants something but the girl doesnt provide it. Think about that. Or think about the next thing u want to complain about. Nobody cares.

I worked at pablos on and off for 5 years. And one thing i can say, and fuck who ever disagree with me.

Pablos can not be blamed for the girls working there.

We take the new guys on a free tour. And I used to tell everyone i took, as it us also in the rules for the girls working there.

Make sure you know what the girl offers and dont offer before taking her through those doors.

In our rules.

Make sure your client knows what you offer and do not offer before you take him through those doors.

And another thing. If you speak to management about your experience and you know for sure that the lady offered you something else. They will defenitly act on the complaint.

And this is a garentee. Pablos is the only club ive ever worked at, as they dont take shit from the girls or the clients. And its the cleanest club ive ever been to. Its a fair club. And its defenitly not their fault if the lady took you for a poes. Its the lady. The last time i worked there they were busy sorting out the sleg between the good ones. Before you leave the club just ask the doorman for management and it will be sorted immediately.
