Hi Guys,

Well yesterday was quite a day so I think everyone is owed an explanation.

Lets begin with some history and please bare with me as I am using an iPad.

3 years ago when Lolly died one of the first moves was to sell the house that we resided in and therefore began a long legal wrangle none of us could have anticipated. We had a ten year lease which at first was honored but a year and a half ago the new owners decided that they wanted to develop the property and therefore began eviction proceedings.

We had to in the mean time take out interdicts to keep the power and water on and began paying the properties rates and taxes as well to avoid the cut.

The first round was thrown out but the second they won, the judge erred by evicting everything despite not joining the business, he made sweeping allegations based on cartoons we had on the website and basically made a moral not a legal call. He completely ignored their written permission to run the massage business there.

We applied for leave to appeal and he declined and we therefore lodged in the court of appeal in Bloemfontein. In the mean time it meant we had to once again lodge interdicts to stop the owners ignoring the legal process and evicting in the meantime.

The ruling came down last week and the CSA declined to hear the case, once again based on the nature of the business.

On taking legal advice we decided not to go through to the constitutional court based on the potential ramifications to the entire industry. We felt it was not for us to jepodies everyone in a quest to fight the owners and therefore conceded defeat.

We then entered into negotiations stating we would drop the other five cases we had for monies and improvements as well as the fact we would leave the property in tact. The agreement was verbally reached between attorneys that next week wednesday would be the day we excited.

Sadly one of the owners is arrogant and likes to show power and therefore yesterday morning i got a call from the sheriff that they were on their way.

It was a hard day but the good news is we had already secured a new venue so only a little discomfort left. They would not even wait for the trucks to arrive, gran and sam took it rather hard and for that I am beyond angry at his distinct lack of compassion for the family. My lawyer holds instructions to screw them now.

The new property is on the corner of our old road and Nicol road. It has massive grounds and business rights. The new landlords know exactly what we do and the lease states as much. Nothing about our services will change and we will move forward by now being able to operate later, something that was hindered by the legal fight.

We thank everyone for standing by us and by wednesday should be completely back to normal, we will set rooms up immediately as we get access on Monday and will begin working ASAP.

It has been a long road and one in which our amazing girls have stood by us, i have seen more love and compassion from these girls than i could ever imagine and it is for them alone we will come back stronger.

Thanks to all of you for standing by us and we look forward to having you in the new venue without the legal cloud hanging over our heads.

Thanks Sean for your explanation which is much appreciated. Although you don't know who I am by my username, you do know who I am by my visits and I sincerely wish you, Gran, Sam and all the ladies all the best.

Sean,

I think I speak for all your customers in saying:
Good Luck with the new premises. We hope you and Sam and Gran will succeed and take Devine to new heights. Sometimes we don't understand why life deals us lemons, only to look back after a couple of years to find the lemonade we made from them was the best ever.

All the best with the move, I'm sure divine will move on and be successfull regardless of the location, ....mmm bigger drive way now :) I hope.

I heard they are opening tomorrow, but this was from one of my mates. So can't be sure.
