Question to the girls.

Does the discussion of legalizing sex work affect the girls at all? What is your opinion about it. Do you think it will improve or reduce business. I just want to know what or how the girls feel about this topic.

I strongly feel it should be legalised. More accountability and safety for the girls.

In some countries that its legal... one of the specifications is that the girls cannot have a pimp. They must work for themselves. I think thats a positive step.

Regular health checks, can go to the police regarding a problem client. Plus girls have to declare earnings and pay taxes which is a good thing. (Having tax record helps you purchase property).

With SA being so conservative but at the same time highest rape statistics in the world... i dont imagine this being legalised for a good few years.

Remember we had this discussion a while back, and one of our learnerd friends pointed out that is was not "legalizing" but "decriminalization" of sex work that are been discussed.

Not sure what the differences are, but have been told there is.

Decriminalisation basically means that you can't be arrested or prosecuted for sex work, which right now you can. I am not sure what the implications of decriminalisation vs legalisation is for tax etc but I agree 100% with Kitty, it's a win-win situation.

I am aware that Cyril Ramaphosa launched an initiative to protect sex worker rights but the SA National AIDS Council and SA Law Reform Commission did not consider decriminalisation in recent policy reports. I am unable to understand why, as criminalisation simply perpetuates danger for us and clients, perpetuates stigma and ill-treatment from service providers e.g. clinics, and certainly does nothing to protect anyone.

In general I suppose I am very much for the government staying out of people's bedrooms :)

Sorry just wanted to add... according to the law, sensual massages and hand relief is legal. Its bj, FH and Greek that is illegal. I had the discussion with a lawyer who represents two big brothels in Johannesburg.

Also, as some clients have tried to do... threaten to have you arrested for prostitution if you dont give them freebies...

If a client messages a girl enquiring about services, he is the one soliciting. Not the girl. So legally she is in the clear. But if she is at a casino and whispers to a man 'R500 for a blow?' She is the one soliciting and is liable.

In the raids I have heard about, I havent heard of any girls being arrested for prostitution but for drugs and/or visa issues.

However cops do regularly pick up street walkers as that is soliciting and to be honest, more about their safety.

I have heard the decriminalize and legalise debate and I stand for legalising it. You dont want to be prosecuted and want to be protected as a right... thats fine but then take responsibility and pay taxes, set up regular payments into an account etc. In the end you win! You can get finance for a car, house, loan etc.

I strongly feel legalization and decriminalisation needs to happen honestly. Every human being needs to be protected and innocent women, daughters, mothers, sisters are working in dangerous situations where they arnt protected and are forced to work as slaves for pimps and are harmed by drug abuse even...these women arnt criminals just human beings forced to survive in a very brutal capitalist society...i wish it was better for the individuals I've met...i hope in the future that this is is a possibility....besides sex is not the enemy...every species on this planet would agree with that statement

You have misunderstood the difference between decriminilisation and legalisation.
I've discussed it at length in another thread, so I will just mention it briefly here.

Under decriminilisation this activity is legal (there can be no prosecution) and there is full protection also, because the ladies will fall under the definition of "employee" under the Labour Relations Act and the Basic Conditions of Employment Act (LRA protects from unfair dismissal etc and BCEA regulates working hours etc).

Under legalisation the same rights apply as the above but there are more stringent rules that will apply, for example, this kind of work might only be allowed in business areas. And also, the ladies might have to register with the government. Basically there are more stringent "legal" rules that have to be followed in this business than others.

Many ladies in Europe prefer decriminilisation because they don't want to register with the government etc.

Thankyou. I suppose I wasnt clear in my response. I believe in the legalisation of it and that it should be done with more rules and abide government regulations but that is my preferance. What do I know ;) I am a blonde after all
